About the Journal
Journal Temas Procesales
is a project directed by the Red Foundation for the Study of Procedure and Justice, which seeks the dissemination and construction of academic dialogues around procedural law and the administration of justice. This journal was founded by Dr. Beatriz Quintero de Prieto from the Center for Procedural Law Studies in 1981 and, in 2011, was taken up again by the Red, under the leadership of its coordinator Dr. Diana Ramírez, as one of the main projects for positioning procedural law in the region and in the world.
Journal Temas Procesales aims to conduct a deep, critical, and systematic study of procedural law, understood not as a mere collection of adjective or instrumental rules, but as an autonomous and substantive branch of legal science. In coherence with the doctrinal tradition that conceives the process as an inherent necessity of social life and the realization of law, the journal addresses the process in its broadest dimension: as a jurisdictional activity of the State, as a succession of acts over time, and as a procedure regulated by norms that guarantee justice and legal certainty.
The publication promotes the analysis of the fundamental concepts of the discipline: jurisdiction, action, process, procedure, evidence, res judicata, and their relationship with so-called substantive law. It expressly rejects the subordinated view of procedural law as a mere instrument at the service of substantive law, and adheres to the thesis that both kinds of norms concur on an equal footing to define the individual legal norm (the judgment). Likewise, the journal accepts the suggestion that the field of study could be called "jurisdictional law", without prejudice to maintaining its historical name.
The journal also aims to foster social criticism, disruptive thinking, and the integration of humanistic and scientific knowledge around the administration of justice, thus contributing to overcoming the contemporary procedural crisis and to the formation of a solid Ibero-American academic community.

Target Audience
Journal Temas Procesales is a scientific journal directed by the Red Foundation for the Study of Procedure and Justice. Its main mission is to promote the dissemination of knowledge and foster the construction of academic dialogues around two fundamental areas: procedural law and the administration of justice. Since 1981, the publication has consolidated itself as a publication aimed at positioning procedural law in the region and the world. In line with the highest international standards, the journal began its path towards indexing in 2021, guaranteeing compliance with rigorous transparency and editorial management criteria. WRITING AND STYLE CRITERIA

The length of the article must be between 8,000 and 10,000 words, including abstracts, keywords, references, and annexes.

The title must be in Spanish and English.
-
Author information must mandatorily include: ORCID link, Google Scholar link, and CVLAC link (if a national author). Also their full names, identification number, institutional affiliation, email, and contact phone number.

The article must include an analytical abstract of maximum 350 words and be accompanied by three to eight keywords. The title, abstract, and keywords must be in Spanish and English or Portuguese.

The font type must be Times New Roman. Article title, in Spanish and English or Portuguese, with 14-point size, subtitles 12 points, and footnotes 10 points.

Justification and line spacing: justified and single-spaced.

Margins: 3 cm on each side.

Bibliographic references and in-text citations must follow the style guidelines of the American Psychological Association (APA), latest edition.

When quotes exceed 40 words, they must be in a separate paragraph, indented, and without quotation marks.

Citations with URLs must work.

Graphics, figures, tables, and other elements must be included in the body of the document. In addition, they must be attached in their original format if they come from another medium.

Types of Articles
Following the guidelines for the journal's indexing process, the following types of texts will be given priority for publication[1]:

Research and innovation article. A document that presents original and unpublished production, resulting from a research, reflection, or review process and project.

1.1. Article resulting from a research process. A document that presents in detail the original results of a completed research project.
-
1.2. Reflection article. A document that presents the results of a completed research project on a specific topic from an analytical, interpretive, or critical perspective of the author, using original sources.
-
1.3. Review article. A document resulting from a completed research project that analyzes, systematizes, and integrates the results of published or unpublished research on a field of science and technology, in order to account for advances and development trends. These types are characterized by presenting a careful and pertinent bibliographic review of at least 50 references.

1.4. Case report. Document presenting the results of a study on a particular situation in order to disseminate the technical and methodological experiences considered in a specific case. It includes a commented systematic review of the literature on analogous cases.

On the other hand, the following types of documents may also be accepted for the editorial process, although to a lesser extent:

Short article. A brief document that presents preliminary or partial original results of a scientific investigation that generally requires prompt dissemination.

Case report. A document presenting the results of a study on a particular situation in order to disseminate the technical and methodological experiences considered in a specific case. It includes a commented systematic review of the literature on analogous cases.

Topic review. A document resulting from the critical review of the literature on a particular topic.

Editor's letter. Critical, analytical, or interpretive position on documents published in the Journal that, in the opinion of the Editorial Committee, constitute an important contribution to the discussion of the topic by the relevant scientific community.

It is a document written by the Editor, a member of the Editorial Committee, or an invited researcher on guidelines in the thematic domain of the Journal.

A document that formulates the translation of classic or contemporary texts or transcriptions of historical documents or of particular interest in the Journal's publication domain.

Review. A manuscript dedicated to highlighting positive aspects and constructive criticism regarding a text, which may be a doctrinal book, a judgment, a literary work, among others.

Procedure for Submission, Evaluation, and Selection of Articles
The procedure for selecting articles is as follows:

The author sends the proposed article to the call and the complementary documents to the email: revistatemasprocesalesred@gmail.com

The Editor carries out the first review of the proposed text. They check compliance with the required formalities for article presentation, as well as its structure and components. If compliance is verified, the article goes to the selection of evaluating referee(s); otherwise, it will be returned to the author stating the reasons for rejection, and a deadline is set to correct the identified weaknesses in the text if applicable.

If the proposed article meets all basic form and style terms, the Editor brings the text to the attention of the Journal's Editorial Committee to decide on the appointment of evaluating referee(s).

The Editor sends the text to the selected peers, who are granted a period of fifteen (15) ordinary days to carry out their work. The evaluation form to be completed is also sent, and it is clarified that the review is under the double-blind modality.

Upon expiration of the evaluation period, the peer's assessment is presented to the author, including the decision on the publication of the article, which may be:

Accept the article for publication without modifications.
-
Accept the article without substantive changes.
-
Accept the article with major modifications.
-
Not publish the article.

The Editor communicates the decision to the author as soon as possible.

In the event that the decision is acceptance conditional on making modifications and adjustments, the editor will consult the author on their willingness to continue with the editorial process. If the author's response is negative, the article is considered rejected; if the author's response is positive, a new period of 15 calendar days is granted to make the adjustments and modifications, and to return the new version of the manuscript to the Journal's Editor.
Articles must always be sent with the Cover Letter and Authorization (available on the website). The author will be solely responsible for any violation of copyright, so the direction of the Journal Temas Procesales reserves the right to accept and publish literature reviews, adaptations, and translations, in which case the author must state this fact and include the corresponding bibliographic reference.
The Journal assumes no responsibility for any eventual damage suffered in the sending or loss of material; nor does it assume the obligation to return articles that are not accepted, which is why it is important that the author keeps a copy of the article sent to the call.

The procedure for selecting, evaluating, and accepting articles is pedagogical, methodological, and constructivist and has the following steps:

The author(s) send the article proposed for the permanent call to the email.

The Editor checks compliance with the required formalities for article presentation, as well as its structure and components.

If optimal compliance is verified, the article goes to the selection of evaluating referee(s); otherwise, it will be returned to the author stating the reasons for rejection. The editor reviews and verifies using Turnitin or the current anti-plagiarism program.

The article is brought to the attention of the Journal's Editorial Committee to decide on the appointment of an evaluating referee.

The Editor sends the text to the evaluating referee, who is granted a period of 15 calendar days to carry out their work; the evaluation form to be completed is presented, and it is clarified that the review is under the double-blind modality.

Authorship of Scientific Works: Authors must comply with the criteria established by the Red Foundation for the Study of Procedure and Justice to determine authorship of scientific works. An author is considered to be someone who contributed significantly to the conception, design, analysis, interpretation of data, and preparation of the manuscript. The order of authors should reflect their contribution to the work, following the accepted guidelines in the discipline. Authorship can be determined using the CRediT taxonomy system.

It is based on principles such as reproducibility, transparency, and collaboration. This practice encourages the participation of diverse actors beyond the traditional scientific community, promoting information exchange and openness in knowledge creation and evaluation processes. It covers all scientific disciplines and academic practices, contributing both to the advancement of science and the well-being of society. It takes a comprehensive approach that promotes free and open access to all forms of scientific knowledge, including publications, research data, educational resources, software, and equipment, through open licenses or the public domain. It facilitates the reuse, adaptation, and distribution of these resources, ensuring their availability to all people without diversity restrictions. In addition, it incorporates transparent research methodologies and evaluation processes, supported by shared infrastructures and governance principles that guarantee reproducibility, interoperability, and multidisciplinary collaboration, benefiting both science and society (UNESCO, 2021).

Equal opportunities: All involved in open science must have the same opportunities for access and contribution, regardless of location, race, gender, socioeconomic level, or other personal characteristics (UNESCO, 2021).

Responsibility, respect, and accountability: Open science implies greater responsibility in the actions of researchers, including public accountability, ethical integrity, and consideration of the social and ecological impacts of research (UNESCO, 2021).

Collaboration, participation, and inclusion: Open science fosters interdisciplinary and global collaboration, integrating social actors and marginalized communities in solving important social problems (UNESCO, 2021).

Flexibility: Given that there is no single approach to open science, different forms and rhythms of transition must be respected, adapting to diverse contexts and technologies (UNESCO, 2021).

Sustainability: Open science must be sustained by long-term funding models and structures, ensuring equitable participation of researchers from all regions and ensuring continuous and unrestricted access (UNESCO, 2021).
For this reason, entities such as Latindex, Redalyc–AmeliCA, LA Referencia, and CLACSO expressed their recognition to UNESCO for the Recommendation on Open Science, approved in 2021. Highlighting that in Latin America and the Caribbean, knowledge has historically been considered a public good, with a tradition of open access to knowledge. However, the globalization and commercialization of research have imposed uniform criteria that dilute local contributions. The transition to Open Science must respect cultural diversity and avoid the commodification of knowledge. A universal regulatory framework is needed to guarantee equity, integrity, and international collaboration in the dissemination of knowledge. Furthermore, it advocates for generating adequate indicators that reflect local scientific production, supporting initiatives such as FOLEC-CLACSO to reform scientific evaluation systems (CLACSO, 2022).
Along the same lines, the Barcelona Declaration was made by organizations that do, finance, and evaluate research, and they commit to:

Making openness the norm for the research information they use and produce. They will support sustainable infrastructures for open information, contributing equitably to their governance and financial stability, and applying good sustainability practices (Barcelona Declaration on Open Research Information, Kramer, & Waltman, 2024).

Working with services and systems that facilitate the opening of research information. They will require that research metadata and results be available in open academic infrastructures, using standard protocols (Barcelona Declaration on Open Research Information, Kramer, & Waltman, 2024).

CONPES 4069
In the Colombian case, the Ministry of Science, Technology, and Innovation created the Colombian Open Science Policy, which seeks to increase the contribution of science, technology, and innovation (STI) to the social, economic, environmental, and sustainable development of the country, with a territorial and participatory approach. Its specific objectives include:

Foster scientific vocations in children and young people, strengthen human capital in STI, and improve the insertion of PhDs in the productive sector (CONPES 4069, 2021).

"Temas Procesales adheres to international ethical principles on AI use in scientific publication. Authors must declare any use of these tools, assuming full responsibility for their content.
