Algorithmic-epistemic injustice and evidential assessment: evidential challenges of testimonial injustice and guidelines to minimize its risks in judicial decisions

This article aims to formulate epistemological, legal, and technical guidelines that contribute to strengthening the administration of justice, based on the need to mitigate the risk inherent in algorithmic-epistemic injustice. To achieve this proposed objective, a qualitative research project was developed, based on an analytical-deductive approach. This methodology integrated documentary analysis with the application of the phenomenological approach characteristic of the philosophical tradition, concretizing an interdisciplinary approach to the problem under study, which has been called algorithmic-epistemic injustice. Algorithmic injustice can be combined with epistemic injustice, to the detriment of individuals and groups historically excluded and vulnerable to access to justice and effective judicial protection. Therefore, a proper understanding of these injustices is required to minimize their risks and strengthen judicial protection and the observance of procedural guarantees in scenarios where AI systems are applied in the administration of justice.
