Some Notions About the Evidence in the Process, the Burden of Proof, and the Proof of Office

This paper addresses some notions about evidence, understanding it as an indispensable element in the judicial process, seeking the accreditation of the disputed facts in order to provide the judge with the highest degree of knowledge and certainty for the fair resolution of the process, all of which involves all the participants of the process, including the judge. To this end, initially some general notions will be alluded to, such as the concept of evidence, judicial evidence, its elements, what must be proven and why it is proven; taking it as a theoretical framework prior to the study of the burden of proof, where its legal foundations will be addressed, and its various applications in some jurisdictions, analyzing the nuances that are made to such institution, according to the judicial nature of the same. Finally, we will focus on ex officio evidence, analyzing what the concept derives for the role of the judge in the judicial process within the framework of the Social State of Law, linked to the function of the administration of justice and the guarantees of due process and effective judicial protection.
